Guide to completing licence application form


1. Where to obtain the application forms?

The application forms are available:
  1. From the EAA office.
  2. This website.
2. Where should the application forms be submitted?

Applicants should submit completed application forms and supporting documents in person at or by mail to the EAA office. The fact that an application and payment are accepted does not mean that a licence will necessarily be granted. A licence will only be granted if an applicant meets all the licensing requirements under the Estate Agents Ordinance. 3. Application for a salesperson's licence ( Form 4 (SN))

Form 4 consists of 2 parts; it
  1. requires the applicant to provide his / her personal particulars;
  2. requires the applicant to answer a few questions conerning the fit and proper requirement and make a declaration.
A photograph (40 mm x 50 mm) of the applicant should be affixed on the application form. Applicants wishing to obtain an estate agent card should ensure that the photograph is in the right specifications.

Applicant should provide the following supporting documents if he / she is a new entrant:
  1. Proof of educational qualifications;
  2. Proof of having passed a qualifying examination within the past 12 months; and
  3. Original HKID Card or travel document.
4. Application for an estate agent's licence (individual) (Form 2 (EN))

Form 2 consists of 2 parts; it
  • requires the applicant to provide his / her personal particulars;
  • requires the applicant to answer a few questions concerning the fit and proper requirement and make a declaration.
A photograph (40 mm x 50 mm) of the applicant should be affixed on the application form. Applicants wishing to obtain an estate agent card should ensure that the photograph is in the right specifications.

Applicant should provide the following supporting documents if he / she is a new entrant:
  1. Proof of educational qualifications;
  2. Proof of having passed a qualifying examination for estate agents within the past 12 months; and
  3. Original HKID Card or travel document.
5. Application for Estate Agent's Licence (Company) (Form 3 (CN))

Section A of Form 3 must be completed and signed by a representative of the company applying for a licence. The representative must be a licensed estate agent having effective control of the company's estate agency business.
Each individual director of the company without a valid estate agent's licence is required to complete and sign Section B of Form 3.

In case a directorship is held by a company without a valid estate agent's licence, that company is required to complete and sign Section C of Form 3.

Applicants are required to provide a copy of the following documents:
  1. Valid Business Registration Certificate; and
  2. Any document from the following list showing the company name and number: certificate of incorporation or any document having been filed with the Companies Registry; and
  3. Any document from the following list showing the latest board of directors: Latest Annual Return (NAR1) or Incorporation Form (Company Limited by Shares)(NNC1) and/or Notice of Change of Company Secretary and Director (ND2A) [including the Protected Information Report of the above documents showing the full identification numbers of directors (Hong Kong Identity Card/Passport)]; and
  4. Any document from the following list showing the latest registered address: Annual Return (NAR1) or Notice of Change of Address of Registered Office (NR1).
A statement of particulars of business will also be issued at no extra charge when a licence is granted. If a company wishes to operate its estate agency business at an additional location, a Form 8 (SPOB-NB) should be used to apply for an additional SPOB for that location.

6. Application for Statement of Particulars of Business *

An estate agent must apply for a statement of particulars of business for each place of business under each business name. The statement must be displayed at a conspicuous position at the relevant place of business.

Form 8A requires the applicant to provide information on the business.

The applicant will be asked to provide a copy of a valid business registration certificate issued by the Inland Revenue Department. Operators of sole-proprietorships or partnerships will also be asked to provide a copy of a certified extract of information of the Business Register from the Inland Revenue Department (enquiry hotline is 2594 3143). Estate agents should note that whether they have applied for a business registration with the Inland Revenue Department or not, they must apply for an SPOB BEFORE they carry on an estate agency business.

Form 8B is applicable only to a partnership applying for a statement of particulars of business. Each and every partner has to complete and submit a Form 8B.
