ୋ28ૢሜݟʃଡ଼ 1 Section 28 Investigation Panel 1
ᔖᛆᇍఖj Terms of Reference:
1. ఱνО፯՟ცࠅ࣬ኽήପ˾ଣૢԷ‘ୋ28ૢ 1. To formulate guidelines for and procedures on the selection
࢝කሜݟٙࡈࣩՓ֛ܸˏձ೻ҏf of cases for investigation under section 28 of the EAO.

2. ္ຖ࣬ኽήପ˾ଣૢԷ‘ୋ28ૢආБٙሜݟd 2. To oversee the conduct of investigation under section 28 of
ᆽڭሜݟʈЪୌΥجԷ஝֛f the EAO to ensure its full compliance.

3. ટաձϽᅇ္၍҅Б݁௅ژఱՉႩމϞცࠅ࣬ 3. To receive and consider reports and recommendations from
ኽήପ˾ଣૢԷ‘ୋ28ૢආБሜݟٙᕿဲא the EAA Administration on suspected or alleged cases of
ऒ෶༼ˀאӚϞ፭ςήପ˾ଣૢԷ‘ٙ஝֛ breaches or non-compliance of a requirement(s) or other
אՉ˼ૢ˖ٙࡈࣩהяʹٙజѓձܔᙄf provision(s) of the EAO warranting investigation under section
28 of the EAO.

4. ࣬ኽήପ˾ଣૢԷ‘ୋ28ૢ։΂ሜݟࡰd࢝ 4. To appoint investigator(s) under section 28 of the EAO to
කʃଡ଼ႩމϞცࠅٙሜݟʿੂБՉႩމϞცࠅ conduct such investigation and carry out such duties as the
ٙᔖਕf Panel considers necessary.

5. ટաձϽᅇ࣬ኽήପ˾ଣૢԷ‘ୋ28ૢʃଡ଼ 5. To receive and consider the reports and recommendations
։΂ٙሜݟࡰה౤ʹٙజѓձܔᙄf from the investigator appointed by the Panel under section 28
of the EAO.

6. νሜݟࡰܔᙄʃଡ଼༈ϽᅇБԴήପ˾ଣૢԷ‘ 6. Where the investigator recommends to the Panel that the
ୋ30ૢהࠈ׼ٙߏܛஈʱٙᛆɢdۆਗ਼Ϟᗫ exercise of disciplinary powers under section 30 of the EAO
ࡈࣩᔷʹߏܛ։ࡰึஈଣf should be considered, to refer the case to the Disciplinary
Committee for its consideration.

7. ʔࣛܲ։ࡰึ˴ࢩܸˏϓͭɓࡈ͟։ࡰึϓࡰ 7. To set up a task force as may from time to time be directed
ଡ଼ϓٙʈЪʃଡ଼d˸ੂБ։ࡰึ˴ࢩה։ݼٙ by the Panel Chairman, comprising any member(s) of the
ʈЪdᄲᙄʃଡ଼ٙʈЪഐ؈dʿቇࣛΣ໨ԫ҅ Panel, to carry out such tasks as the Panel Chairman may
౤ʹܔᙄf assign; to deliberate on the findings of the task force; and to
make recommendations to the Board for approval as
appropriate.

8. νႩމცࠅdఱБԴήପ˾ଣૢԷ‘ୋ28ૢ 8. To obtain legal and/or expert advice or service relating to the
הࠈ׼္ٙ၍҅ᔖঐձᛆɢᐏ՟جܛʿŊאਖ਼ exercise of the EAA’s functions and powers as prescribed by
ุจԈא؂ਕf section 28 of the EAO as and when the Panel considers
necessary.

9. БԴʿੂБήପ˾ଣૢԷ‘ୋ28ૢהࠈ׼ٙ 9. To exercise and perform any and such of the EAA’s functions
္၍҅ᔖঐձᛆɢf and powers as prescribed by section 28 of the EAO.
