About the Charter

 

  • Introduction

Estate agents play a pivotal role in ensuring the tenancies of subdivided units (“SDU”) comply with Part IVA of the Landlord and Tenant (Consolidation) Ordinance. The Estate Agents Authority (“EAA”) believes good practices in handling SDU tenancy can safeguard the interests of both the tenant and the landlord, which is also in line with the professional ethics of estate agents.

In this regard, the EAA encourages the estate agency trade to step forward and promote their professionalism by signing the “Charter on Good Practices of Estate Agents in Handling Subdivided Unit Tenancy” for exercising good practices and assisting all involved parties in complying with the relevant requirements.
 

  • Statement of Commitment

The two “won’ts”:

  1. We won’t assist the landlord to overcharge for public utilities and services
  2. We won’t assist the landlord to contravene the requirements for security of tenure

The six “wills”:

  1.  We will explain to the landlord the legal responsibility for stamping an SDU tenancy agreement
  2. We will remind the landlord in writing to provide the tenant with rent receipts within seven days and submit Form AR2 within 60 days
  3. We will provide Form AR3 to the tenant
  4. We will adopt the SDU tenancy agreement template recommended by the Government or the EAA
  5.  We will explain the terms of the SDU tenancy agreement to the tenant clearly
  6.  We will arrange training for our employees
     
  • Benefits of Signing the Charter
  1. The signatory can post the Charter logo sticker on shop windows and display promotional collaterals inside the shops
  2. The name of the signatory will be included in the online list of participating estate agency shops
  3.  Landlords and tenants of SDU can easily identify the estate agency shops adopting good practices in handling SDU tenancies
  4. The signatory can showcase its professionalism to the public
