Re: Regulated Tenancies of Subdivided Units - Second Term Tenancy and Relevant Information

Since the first batch of regulated tenancies is about to approach their second term tenancies, the Estate Agents Authority received a letter from the Rating and Valuation Department (“RVD”) requesting licensees’ assistance to remind landlords of regulated tenancies the procedures that need to be followed pertaining to the second term tenancies. Related key points include: the landlord of a regulated tenancy must fill in the Form AR1 stating the proposed renewed rent and sign it within the offer period, which is the second calendar month immediately before the calendar month in which the purported second term tenancy commences, and serve it on the tenant to make a second term offer. If the tenant accepts the offer, the tenant must sign and serve the Form AR1 received on the landlord of a regulated tenancy before the expiry of the first term tenancy for handling.
